Terms of service

These Terms of Service ("Terms") govern your access to and use of Instance's website, dashboard, and related services (collectively, the "Service"). By creating an account, connecting an Instagram account, or otherwise using the Service, you agree to be bound by these Terms.

1. Eligibility

You may use Instance only if you are at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the business you represent. By using the Service, you represent and warrant that you meet these requirements.

2. Your account

You are responsible for maintaining the security of your account and credentials, including any third-party logins (such as Instagram). You agree to notify us promptly of any unauthorized access or suspected breach of security.

3. Use of the Service

You agree that you will not:

• Use Instance in violation of any applicable laws or Instagram / Meta platform policies.
• Send spam, unsolicited messages, or misuse automation in a way that harms recipients or risks your social media accounts.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.

4. Instagram and third‑party services

The Service integrates with Instagram and other third‑party platforms. Your use of those platforms is governed by their own terms and policies. You are responsible for maintaining valid permissions and complying with all third‑party requirements.

5. Customer data and privacy

You retain all rights to the data you submit to the Service, such as leads, conversations, and CRM information ("Customer Data"). You grant Instance a limited license to process Customer Data solely to provide and improve the Service. Our use of personal data is further described in our Privacy Policy.

6. Intellectual property

Instance, the logo, and all related product names and designs are trademarks or service marks of Instance. All software, code, and content provided as part of the Service are owned by us or our licensors and are protected by intellectual property laws.

7. Fees and payment

If you choose a paid plan, you agree to pay the applicable fees according to the plan you select. Fees are typically non‑refundable except where required by law or explicitly stated otherwise.

• Trials and free periods – When we offer a free trial, no credit card is required and your trial does not automatically turn into a paid subscription. If you want to continue with a paid plan after the trial, you must actively choose and purchase a plan.
• Renewals – We do not currently auto‑renew or auto‑charge. When your paid period ends, you can manually renew or upgrade again from within the product.
• Changes to pricing – We may change pricing with reasonable notice. Any price change will apply only to future purchases or renewals and will not change what you have already paid for.
• Failed or late payments – If a manual payment fails or is not completed, we may limit or pause access to paid features until payment is successfully processed.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non‑infringement.

9. Limitation of liability

To the fullest extent permitted by law, Instance and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Service.

10. Term and termination

These Terms remain in effect while you use the Service. You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, misuse the Service, or create risk or possible legal exposure for us or other users.

11. Changes to the Service and Terms

We may update the Service and these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you by email or in-app notifications. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any disputes arising out of or in connection with the Service will be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
